I have the honour to place before you the following
facts :- (1). Er. Duncan who was engaged as an assistant Engineer under an agreement to assist with the harbour Refuge contract has recently been placed upon the nermanent establishment of the public works Department, and given seniority over all -
other Assistant Engineers.
(2). As the senior Assistant Engineer immediately concerned I at once approached the Bon: Colonial Secretary asking if lis Excellency the Governor would reconsider the matter (copy of this letter attached and marked "A"}. The reply from the Government stated "that as Ar. Duncan's total emoluments equalled the maximun pay of a 1st Grade Assistant Engineer, and as he was in receipt of this amount before I was advanced to the 1st Grade of Assistant Ingineers, he would be considered senior to me although junior in service" (copy

In my reply I ventured to contest the view that T. Duncan's special allowance should be taken into consideration in determining his position on the Public torka Department staff and that my total length of service should be ignored in his favour. At the same time I asked to be advanced to the position of 2nd grade Executive Engineer in order to retain my seniority (copy "C" attached also the Government's reply "D") (3) The Government having decided that total emoluments in the same grade govern seniority, and not length of service, I would respectfully point out the injustice this entails to all members of the Public works Department staff senior in service
